WHAT TYPES OF RESTRAINING ORDERS ARE THERE?

There are different types of restraining orders and it depends on your situation what kind of restraining order is suitable for you to obtain. If it is a domestic violence situation, you may want to obtain a domestic violence restraining order. If it is a civil harassment situation, you may want to obtain a civil harassment restraining order. If it is an elder abuse situation, you may want to obtain an elder abuse restraining order. If it is a dependent adult abuse situation, you may want to obtain a dependent adult abuse restraining order. If it is a workplace situation, you may want to obtain a workplace violence restraining order. If it is a gun violence situation, you may want to obtain a gun violence restraining order.

WHAT’S THE DIFFERENCE BETWEEN A TRO AND A REGULAR RESTRAINING ORDER?

A Temporary Restraining Order (TRO) may be issued to you if you show reasonable proof of harassment to the satisfaction of a San Diego court and that great or irreparable harm would result if order not granted. The TRO is usually good for 21 days. A temporary restraining order can be in effect until your hearing for a regular restraining order. The hearing is usually held between 21 to 25 days after a temporary restraining order is granted. At the hearing for a regular restraining order, the judge will hear from both sides if present and their lawyers if they retain lawyers and decide if a regular restraining order is justified per California law. After the hearing, if the judge issues a final restraining order, it is good for five years and can be renewed for additional five years.
